Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court.

The small claims court exception does not allow class, collective, consolidated, representative, or mass claims.

28. Intellectual Property Injunctive Relief Exception

Either party may seek temporary, preliminary, or permanent injunctive relief in court to protect intellectual property rights, confidential information, website security, or unauthorized use of content, without first completing arbitration.

29. Class Action Waiver

YOU AND TOP RATING LIST AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND TOP RATING LIST WAIVE THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED PROCEEDING.

The arbitrator may not preside over any class, collective, consolidated, or representative proceeding unless both parties expressly agree in writing.

If this class action waiver is found unenforceable as to a particular claim or request for relief, then that claim or request for relief may be severed and brought in court only to the extent required by law, while the remaining claims must be arbitrated.

30. Jury Trial Waiver

To the extent any dispute proceeds in court rather than arbitration, you and Top Rating List knowingly and voluntarily waive any right to a trial by jury, to the maximum extent permitted by law.

31. Venue for Court Proceedings

For any claim not subject to arbitration and not eligible for small claims court, you and Top Rating List agree to the exclusive jurisdiction and venue of the state and federal courts located in California, unless applicable law requires otherwise.

You consent to personal jurisdiction in those courts.

32. Severability

If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed if necessary.

The remaining provisions will remain in full force and effect.

33. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

Any waiver must be in writing and signed by an authorized representative of Top Rating List.

34. Assignment
